The right to abortion could enter the Constitution

The President of the Republic Emmanuel Macron announced this Sunday, October 29, that he wanted to submit a law to the Council of State to include the freedom to abort in the Constitution.

Will the right to have recourse to voluntary termination of pregnancy be enshrined in the Constitution? The announcement this Sunday, October 29, made by the President of the Republic Emmanuel Macron on X (ex-Twitter), goes in this direction. “Based on the work of parliamentarians and associations, the draft constitutional law will be sent to the Council of State this week and presented to the Council of Ministers by the end of the year, he writes. According to the Head of State’s announcement, the decision should be taken next year. In 2024, the freedom of women to resort to abortion will be irreversible, he promises on the social network. A commitment he made on March 8, International Women’s Day, in a context of concern after the decline in the right to abortion in the United States.

According to La Tribune Sunday, the paragraph is even already written and should be added to Article 34 of the Constitution: “The law determines the conditions under which a woman’s freedom is exercised, which is guaranteed to her, to have recourse to a voluntary termination of pregnancy.” As recalled South Westa bill going in this direction, carried by the elected official La France insoumise (LFI) Mathilde Panot, had already been voted on in 2022 in the National AssemblyFor “guarantee the right to voluntary termination of pregnancy”. Then, in 2023, the Senate voted for another text replacing the word “right” by the expression “women’s freedom”. The LFI deputies also wanted to work on this latest version during their parliamentary session, on November 30. “We will only agree to remove the text from our parliamentary niche if the government has tabled an ad hoc text, reserved for this question”declared MP Mathilde Panot on October 17.

The text will be presented in 2024

According to our colleagues, once passed by the Council of Ministers in the coming weeks, the text supported by the head of state should be brought before Congress in spring 2024. At least three out of five parliamentarians must agree with the bill for it to pass. As a reminder, the right to abortion has been part of the public health code since 1975, thanks to the Veil law. Its inclusion in the Constitution would complicate any attempt to remove or undermine this right.
