The union of hostesses and stewards who accused the Spanish low-cost airline Volotea of replacing striking employees in Nantes was dismissed by the interim judge, according to an order consulted Monday by AFP.

The judge in chambers considers in his decision that “the documents provided on this subject by the SNPNC (National Union of Commercial Flight Crew) are not such as to establish (…) that the legal requirements have been violated”.

“There is therefore no need for interim relief”, continues the judge.

The SNPNC accused Volotea of taking advantage of the obligation that air transport employees have to notify their employer of their participation in a strike movement 48 hours in advance to call for replacements.

The SNPNC lawyer told AFP that he would appeal this decision.

“There is a clear and obvious correlation between the fact that employees are transported to the bases affected by the strike movement before the planes take off and the use of information contained in the declarations of intent of the strikers”, supports Me Fiodor Rilov.

Volotea’s flight crew had launched a strike in mid-April to protest against “precarious” working conditions and “insufficient” pay.

At the beginning of April, nearly 350,000 euros in fines had been requested against Volotea and its HRD before the Nantes police court for breach of the legal duration of working time.
