TikTok launches its legal fight in the United States against the law intended to ban it

The parent company of TikTok, ByteDance, counterattacks in the United States. They want to see the country’s courts invalidate the law which wants to force it to sell TikTok in the USA, or leave.

The TikTok soap opera in the USA reached a critical stage last April with the vote on a law, then its ratification, which gave nine months (with a presidential possibility of extending this deadline by three months) to the giant ByteDance to sell TikTok. An obligation that the management of TikTok had announced even upstream of the legislative process that it wanted to fight in the country’s courts. It’s done, since she has just filed a complaint.

A law that would violate the first amendment

The law that will ban TikTok in the United States would be “unconstitutional”. It is on this level that the Chinese giant ByteDance wishes to direct its complaint before the Court of Appeal for the District of Columbia Circuit. For the Chinese giant, the law which will force it to sell the star application of the young generation would repeatedly violate the Constitution of the United States, and above all, its first amendment.

An attack that ByteDance considers exceptional, and a bad omen. “ For the first time in history, Congress has passed a law that subjects a single named speech platform to a permanent nationwide ban » explains the group in its complaint.

The alternative of transfer is not one

And to support its complaint, ByteDance adds that the alternative of “ sell » would not be one of them, the imposed deadlines preventing any potential transfer operation. Selling within nine months would not be “ simply not possible: neither on a commercial level, nor on a technological level, nor on a legal level. »

But in any case, even if the fight in court ended in a defeat for TikTok, the application would probably not be sold. Its algorithms are in fact considered by ByteDance to be infinitely more important than the revenue generated by the platform in the United States. What predicts a great disappointment to come for the approximately 170 million Americans using TikTok?
