OIn addition to being concerned about the decline in their activity and inflation, SME managers are experiencing difficulties in recruiting and unprecedented turnover, according to the economic survey of the Confederation of SMEs (“Confederation of SMEs”). Some SMEs have already deployed actions to facilitate this balance by moving to a four-day week, like Pimpant (rechargeable family consumer products). On another note, menstrual leave is offered to employees by companies like Goodays (customer interaction management platform). Emmanuel Macron announced on January 16 that he wanted to make it easier for employees to take parental leave. Currently, once paternity or maternity leave has ended, one or both parents can decide to take parental leave before the child turns 3.

Faced with difficulties in finding nurseries or childminders, this option is often considered by employed parents. But, in this case, the employment contract is suspended, the employee is not paid by the company (except in the case of part-time leave). And the minimum social assistance proposed by the Family Allowance Fund is 428.71 euros per month in 2024 (for full-time parental leave for a single child), for a maximum of six months. Companies can of course improve these legal measures.

Reality check

In terms of labor law, the use of certain devices by the employer can contribute to a balance in spheres of life: let us cite the authorization of absence for medical procedures necessary for a medically assisted procreation protocol counting in actual working time (the spouse also benefits from this for three of these exams); compensation from the first day of sick leave in the case of a miscarriage (with no waiting period from the 1ster January) ; the impossibility of dismissal during the ten weeks following a miscarriage, except in cases of serious misconduct; the right of a pregnant woman to be assigned to another position if her state of health requires it; authorization of absence in order to attend compulsory medical appointments during pregnancy and after birth; leave of absence for breastfeeding for one year (unpaid, except under conventional arrangements) for one hour per day…
