Trial twist – Jury ruled it wasn’t attempted murder

A two-day trial in the regional court in Wels against a 66-year-old for attempted murder ended with a bang on Wednesday evening. The jury acquitted him 5-3 on this charge. However, they convicted the pensioner of attempted grievous bodily harm.

It was an unusual process in the regional court in Wels, which still left unanswered questions even after two days of hearings and the questioning of a number of witnesses. Attempted murder was the charge against 66-year-old Rasim D. from Zell/Pram. The native Macedonian got behind the wheel of his car on October 31, 2021 – Halloween evening – after a visit to a local bar, despite an alcohol level of 0.92 per mille in his blood. In Thomasroith, he saw an acquaintance who was taking care of a heavily drunk 24-year-old friend (1.9 per mille). D. stopped, a dispute then broke out between the two drunkards, during which the younger man is said to have insulted the pensioner as “shit Jugo”. . He did so, but is said to have scolded out why the 24-year-old should have tried to climb into the car in a rage. D. should have accelerated in panic to 40 km/h and dragged the drunk about 60 meters. Witnesses were divided Before the court, the witnesses – the acquaintance, the girlfriend of the 24-year-old and his mother – but disagreed in which direction should have driven a car and how many meters the victim was dragged along. The young man suffered abrasions and bruises and was able to run after the driver. Just a shock. He is said to have come back again and attacked the opponent. Allegedly, he could only save himself by jumping to the side. D. claimed that he only wanted to scare the young man and accidentally rammed a traffic sign. Serious facial injuries The witnesses could not say who had inflicted his severe facial injuries on the accused – a broken cheekbone, a fractured maxillary sinus, a broken nose, a bruised chest. The 24-year-old did not want to rule out being responsible for it. Partial prison sentence The jury acquitted D. of attempted murder with a score of 5: 3, but convicted him of attempted serious bodily harm. The sentence imposed: Two years imprisonment, 18 months of which is conditional. However, the judgment is not yet final.
