Twelve injured – only fine after market stall accident in front of pen

Many people still remember the terrible pictures of July 11th. An 86-year-old crashed into a market stall in front of St. Florian Monastery in Upper Austria. Twelve people were injured, and a 68-year-old woman was in mortal danger for days. The driver of the accident is spared one process. He has now been offered a fine.

There was no discussion about the question of fault in the accident. The elderly Mühlviertler, who was injured in the crash and ended up in the hospital with serially broken ribs and a broken sternum, took everything on himself. He couldn’t say how the accident happened, the man spoke of a “blackout”. Which was also confirmed by an expert report ordered by the public prosecutor.

The senior behind the wheel had confused the gas and brake pedals this Sunday morning. A total of twelve people were injured. For several days, the doctors at the Kepler University Hospital in Linz fought for the life of a 68-year-old woman.

Senior returned driver’s license
According to his defense lawyer Klaus Dorninger, the 86-year-old handed in his driver’s license. He never wants to get behind the wheel again. From the beginning, his sympathy went to the victims of the accident that he was responsible for.

No criminal record
Attorney Dorninger assumed charges of negligent bodily harm. His client is not to be blamed for gross negligence. “He was neither too fast nor was he drunk.” But there will be no legal process after the accident in all probability.

According to the Steyr public prosecutor, the person who caused the accident was offered a diversion in the form of a fine. What comes as a surprise even for lawyer Dorninger: “I assume that my client will accept the offer. But I haven’t spoken to him yet. ”If a fine is paid, the Mühlviertel resident has no criminal record. The injured are of course still entitled to compensation for pain and suffering.
