  • The Supreme Court has left an order from the pandemic period in force for an indefinite period.
  • This allows US authorities to quickly deport migrants apprehended at the US-Mexico border.

The restrictions were introduced under then-President Donald Trump at the beginning of the pandemic. Asylum seekers were expelled and most people who applied for asylum at the border were turned away. The restrictions are often referred to as “Title 42” in reference to a 1944 public health law.

Claim and Counterclaim

Immigration advocates have sued to end the use of Title 42. The policy violates American and international obligations to persecuted people.

A federal judge sided with her in November, setting a deadline to end the policy. Conservative states had appealed to the Supreme Court, warning that a surge in migration would strain public services and cause an “unprecedented disaster.”
