In France, education is compulsory for all children, French and / or foreign, from the age of 3 and up to the age of 16. Parents have the option of enrolling their children in public or private schools. However, some families, for various reasons that are specific to them, choose to practice home education. Home schooling is perfectly legal in France. It is supervised and controlled for all children residing on French territory.

By choosing the child’s education, the parents also decide who is responsible for learning. It can be a parent, or both, but also a third party. No specific diploma is required. However, those in charge must justify their choice to an inspector in charge of the control.

Although this option is commonly referred to as “homeschooling”, it can be done at home, but also in a completely different location. The person chosen to teach can teach more than one child, but the children must belong to one and the same family.

In recent years, the number of families choosing homeschooling has continued to increase. In France in 2020, there are nearly 50,000 students declared in family education. Nevertheless, for the start of the 2021-2022 school year, the trend seems threatened.
Indeed, on October 2, the President of the Republic, Emmanuel Macron announced that, from the start of the 2021 school year, the possibility of receiving home education would be strictly limited.

On August 13, the Constitutional Council issued its opinion concerning the law which modifies the legal regime of home education. But what is it really?

For the start of the 2021-2022 school year

It is important to note that for the start of the school year, in September 2021, nothing changes, the rules remain the same as in previous years. Parents have the possibility to choose the mode of instruction which they wish to give to their child. At the start of the school year or during the year, a simple declaration will allow you to start a family education system.

For the start of the 2022-2023 school year

The rules for home schooling will only change from September 2022.
Families having practiced home schooling during the school year 2021/2022 and wishing to continue this learning system must necessarily have given satisfaction at the end of the pedagogical control carried out by the representatives of the National Education.
To begin family education after a year of face-to-face schooling, families must apply for authorization from the rectorate of the academy to which they are attached. These requests are specific to each child.

the legislation provides 4 grounds for requesting authorization (article 49 – point 16)

“The authorization mentioned in the first paragraph is granted for the following reasons, without any other reasons than the best interests of the child being invoked:
1 ° The state of health of the child or his handicap;
2 ° The practice of intensive sports or artistic activities;
3 ° Family roaming in France or geographical distance from any public school;
4 ° The existence of a situation specific to the child justifying the educational project, provided that the persons responsible for it can prove the capacity of the person or persons responsible for instructing the child to provide instruction in family while respecting the best interests of the child. In this case, the request for authorization includes a written presentation of the educational project, the commitment to ensure this instruction mainly in French language as well as the documents justifying the capacity to ensure the instruction in family. “
