Faced with the multiplication of complaints against ChatGPT, the CNIL decided to investigate the OpenAI conversational robot.
After having received no less than five complaints in good and due form, the National Commission for Computing and Freedoms has decided to open a control procedure concerning the artificial intelligence ChatGPT. The latter is already the subject of strong criticism in Canada and Italy, and is causing growing concern in France. What should we expect?

If you have already consulted Clubic this week, you may have come across our article relaying the complaint filed on the CNIL office by the Renaissance deputy Éric Bothorel against ChatGPT. If the latter may seem futile (because it is based on a biographical query of the elected official), it raises a major problem: what about the data processing operated by ChatGPT and OpenAI?
Beyond this complaint, lawyer Zoé Vilain filed three others, as revealed by our colleagues from The Informed. She put on the table the file of the general conditions of use which are not even subject to acceptance by the Internet user, as well as the absence of a clear confidentiality policy.
The fifth complaint is the work of developer David Libeau, a member of the Exodus Privacy & Open Knowledge France association. This one makes more or less the same reproaches as the deputy Bothorel with regard to the false information produced by ChatGPT when responding to a prompt (a request) on his identity.
A framework rather than a ban?
These reasoned complaints prompted the CNIL to react, which has already been studying the issue of artificial intelligence for several months. Given the explosion in popularity of chatbots like ChatGPT, there is no doubt that the data policeman is working at least on the answer to be given. More than a pure and simple ban, we imagine the authority working on a framework for technology.
Today, some of the properties of the chatbot seem to coincide with one or more provisions of the GDPR, the European regulation. As we explained earlier this week, the results provided by ChatGPT can be linked to the GDPR, article 5d of which specifies that “ personal data must be […] accurate and, where necessary, kept up to date “. In addition, the text adds that ” all reasonable steps must be taken to ensure that personal data which is inaccurate […] be erased or rectified without delay “.
Several questions thus arise for the CNIL: what is the true status of ChatGPT? Does it process personal data? Does OpenAI collect consent from its users as it should? The French authority can in any case count on the support of the EDPB (European Data Protection Board) which has just announced the creation of a working group on AI to promote collaboration between the “CNIL » European.
