Microsoft has summoned Sony to appear before the judge in the context of the case between Microsoft and the FTC for the takeover of Activision Blizzard. A maneuver which should allow the manufacturer of the Xbox to thwart certain arguments of the FTC and Sony.

Confirmation that Microsoft has subpoenaed Sony Interactive Entertainment as it tries to defend itself from an FTC lawsuit against the MS bid for Activision

According to case documents shared by reporter Stephen Totilo, Sony has until Jan. 27 to respond to the subpoena by objecting to it or answering questions from Microsoft.

Exposing some Sony secrets

It is difficult as it stands to define what Microsoft seeks to discover with this subpoena. The firm must think that it can find in PlayStation’s testimony elements countering the arguments of the FTC. We can, for example, think of the roadmap of future Sony PlayStation Studios productions which would assure the judge that the future of PlayStation would be bright, even without access to the Call of Duty license.

Anyway, this testimony could force Sony to reveal some secrets. This is what happened during the lawsuit between Epic Games and Apple over the removal of Fortnite from the App Store. Microsoft, Sony and other actors who had been summoned to testify had then revealed secrets about certain practices. We had been able to learn there the conditions imposed by Sony on the crossplayor the way Microsoft wanted to offer the Game Pass at Nintendo and PlayStation.

The lawyers for Microsoft and Sony are now negotiating to better delimit the perimeter of the testimony of the manufacturer of the PlayStation and the extent of what the latter will have to reveal to Justice.
