15 hours of activity to receive the RSA, which changes for you in 5 questions and answers

RSA recipients will have to be held accountable. Prove their active research. Or their volunteering. Or their training. Because the RSA will be well conditioned for 15 hours of activity per week in the coming months. But what activities will be accepted? 3 p.m., or more? For what sanctions? The suspension of RSA? In fact, despite the experiments already underway, many questions remain unanswered…

In 18 departments, we have launched an experiment which conditions the RSA on 15 hours of activity for integration. I am announcing to you that we are generalizing this system in all departments of France by January 1, 2025. During his general policy declaration on Tuesday January 30, Prime Minister Gabriel Attal announced the color: conditional RSA is tomorrow . In the meantime, the system will even be tested in 47 departments by the end of February, broadening the spectrum of a test already underway in 18 departments. But concretely, how is this conditioning articulated? For who? What activities? What we know.

1 – In which departments?

THE 18 pilot departments for months have been known: the North, Yvelines, Bouches-du-Rhne, Creuse, etc. Here is the full list in this card. Clarification: the ongoing experimentation is not binding at this stage in the sense that removals for non-compliance with the conditions are not yet possible.

We will pass 47 [dpartements] by the end of the month [de fvrier], announced the new Minister of Labor Catherine Vautrin, Wednesday February 7 on Public Snat. Which? The minister’s office responds that the list will be detailed during Catherine Vautrin’s next trip to Alsace, in around ten days.

2 – What activities? Working or looking for a job?

What the law says? Because this conditional RSA project is included in the law of December 18, 2023 for full employment, the same text which changed the transfer of Ple Emploi to France Travail on January 1, 2024. However, France Travail integrates a major new feature: Each person will sign a employment contract labor according to its needs (…). It will include, among other things, the action plan which defines the objectives for implementing the professional project, the associated support and/or training measures to promote return to employment.

There is no question of imagining voluntary work, outside the framework of the labor code

Ultimately, it is this engagement contract which will precisely determine the activities that each CAF (or MSA) beneficiary relating to the RSA must follow. But in a detailed page (and recognizing the gray areas or arbitrator points) on this renovation support for RSA recipients, published last summer, before the adoption of the full employment law, the Minister of Labor insists on the fact that the activities will never be employment without pay: there is no question of imagining voluntary work, in outside the framework of the labor code, writes the minister in his frequently asked questions. The 15/20 hours could therefore include activities ranging from immersion in a company to refine one’s professional project, obtaining a driving license, taking steps to access rights or even participating in activities in the associative sector.

What activities are currently being tested in the departments?

What is the reality of these 15 to 20 hours per week of activities for RSA beneficiaries, in 2023, in the 18 departments concerned? In Marseille, the system concerns 2,000 beneficiaries located in the 5th and 7th arrondissements out of the 71,205 beneficiaries in the Bouches-du-Rhne department, reports France 3 PACA: the beneficiaries concerned have weekly follow-up meetings, Ple Emploi, the local mission or other support structure, with the objective of redirecting them towards a local company with needs or able to offer training.

Talking about non-country jobs is a caricature! insisted last October Jean Bassres, now ex-general director of Ple emploi, in Capital. This will indeed be a support activity and not unpaid work.

But the agents of Ple Emploi (renamed France Travail) and the CAF questioned by the online media Basta claim to have no information on the activities carried out… In Strasbourg, where the department wanted to condition the RSA from 2016, the administrative court ruled that it could not impose an unpaid activity. The system does exist but is not obligatory: out of the 39,700 RSA beneficiaries in Alsace, each year, between 400 and 500 people are in an effective volunteering situation, reports Rue89 Strasbourg.

And no official report has been published apart from a progress report from the departmental monitoring committee. It is impossible, at this stage, to have a clear vision of the tests carried out in 2023.

3 – 15 hours per week? How is the duration fixed?

15 hours minimum? 15 to 20 hours of activity? The minimum weekly duration is good at least 15 hours in the law. The precise duration is however customizable depending on the situation of the job seeker receiving benefits, and this must be detailed in the action plan which appears in the employment contract: It includes in particular training, support and support actions.

But… this minimum weekly duration can be reduced, we read in this same text of law, without being able to be zero for reasons linked to the individual situation of the person concerned. In short: case by case.

4 – Can all RSA recipients lose their allowance?

Yes, all RSA beneficiaries are affected. Even if, in fact, RSA beneficiaries who have part-time employment will probably be able to more easily prove hours of activity with a view to returning to employment.

When the job seeker benefits from active solidarity income, it may be suspended or canceled. This has been the law since December 2023. But under what conditions and for what duration, precisely, will the RSA be suspended or deleted? The law refers a decree to the Council of State, which has not yet been published… The law however provides that in the event of suspension, the RSA recipient will be able to recover the suspended sums retroactively if he corrects the shot within 3 months.

5 – How will this work out in 2025?

At this stage, given the vagueness on the claimed activities and the absence of a decree detailing the possible sanctions, the experiments extended to 47 departments in 2024 will be in line with the 2023 tests: reinforced support for RSA beneficiaries excluded of the job market, by simplifying.

It is automatic registration for France Travail in 2025 which will change the situation: all people looking for work will be registered with France Travail, we read on pole-emploi.fr. Not only all those who request this registration, but also all RSA recipients as well as their partner or spouse, young people registered with local missions looking for work and people with disabilities supported by Cap emploi, will all be registered in France Travail from January 1, 2025. However, each person will sign an employment contract, with rights and duties, and therefore a personalized roadmap indicating what will need to be checked in terms of weekly activities to continue to receive the RSA each month.
