- Mexico’s Supreme Court has decriminalized abortion nationwide.

Parliament must revise the penal code. Penalties for abortion, in force since 1931, must be abolished. The criminalization of abortion violates the human rights of women and other persons of childbearing potential, according to the Mexican Supreme Court.
Until now, the Penal Code provided for prison sentences of up to five years for abortions. Not only for the woman, but also for the doctors involved.
A decision has already been made in 2021
In 2021, the Supreme Court ruled that an absolute ban on abortion was unconstitutional. At that time, however, it was only about the state of Coahuila, which is located in the north of the country. After 2021, abortions were still criminalized in 20 of the 32 states. Abortions were only permitted there in special cases, for example after a rape or if the mother’s life was in danger.
The lawsuit for nationwide decriminalization was filed by the women’s rights organization Gire. As a result of the verdict, public hospitals throughout Mexico will also have to grant the right to free abortions in the future.
