A new bill tabled in the National Assembly aims to better enforce copyright in the world of artificial intelligence.

Generative AI is a fantastic tool, which allows you to create a new image, a new sound or a new text with a simple prompt. But this faculty is not magical, it was developed from pre-existing human works. And for many, the use of these works should be remunerated. What a bill proposes to allow.

Several new features to come

Several Renaissance deputies this week tabled a bill “aimed at regulating artificial intelligence through copyright”. It introduces several new features intended to enable greater respect for copyright in works used by AI, at a time when this issue is beginning to take hold in American courts.

The main measure is found in Article 2, and states that “ when the work is created by artificial intelligence without direct human intervention, the only rights holders are the authors or rights holders of the works who made it possible to design said artificial work “.

These rights may be managed by an entity such as authors’ societies. A tax imposed on the production of a “ artificial intelligence device based on works whose origin remains uncertain » for the benefit of the rights collection organization will also see the light of day, as well as a notice to be affixed “work generated by AI”. This may be followed by the name of the artists whose works made it possible to generate the content in question.

What feasibility?

As we see, the legislator sides resolutely on the side of artists and creators whose work is the basis for the development of artificial intelligence models. But while the intention is laudable, the law could prove difficult to enforce. Indeed, how can we know which works were used to arrive at the content generated by an AI after integrating a prompt?

A technical difficulty behind which the giants behind the best-known generative AIs, such as ChatGPT or Midjourney, should not fail to hide in the future. For the moment, it is still only a proposed law. And if it could not on its own resolve the thorny problem of copyright, it should on the other hand make it possible to throw a wrench in the pond and fuel other reflections, these perhaps more at the European level.
