The rise ofartificial intelligence does not only have good sides. Some have taken advantage of it to create videos that are larger than life, but in which AI has modified elements. We think of those which feature someone in superimposing his face on another For example. This is called a deepfake. They can be used, among other things, to create a fake work meeting to scam a company or to make victims of violence speak in disturbing videos now banned on Youtube.
In France, the bill on securing the digital space, which the National Assembly adopted on the day of publication of this article, contains specific measures to better regulate the phenomenon. In particular, it defines criminal penalties for those found guilty of creating a deepfakemore or less heavy depending on the nature of the fake video.
This law provides prison sentences for the creation and use of a deepfake
“This bill plans to adapt the editing offense to artificial intelligence and deepfakes. We will be able to repress those who edit thanks to AI“, specifies Arnaud Dimeglio, lawyer at the Montpellier and Paris bars, specializing in digital law. The text provides for up to 2 years in prison and 45,000 euros fine for the creation of a deepfake featuring a person without their consent. If the video is sexual characterthe penalties increase: 3 years of imprisonment and 75,000 euros fine.

Faced with deepfakes, Internet users do not (yet) have a tool to discern them. Gérald Holubowicz, teacher at Science Po and creator of the newsletter synthmedia.fr which deals with AI, recalls that he “there is no official detector so we have to resort to the good old methods: critical thinking and a little perspective“. Several tech giants like Facebook already integrate systems to signal that a photo has been created by artificial intelligence, but the approach still needs to be extended to video content. Europe provides for this in its AI lawapplicable by 2026.
