It’s strong coffee, but it’s definitely true. The host Arthur, as well as other creditors having invested in the Ethical Coffee Company (ECC), is demanding nearly 300 million euros from Nespresso before the Swiss courts. Information from “La Tribune de Genève” that “Le Figaro” is able to confirm.

However, the adventure had started well for Arthur – who for his part would have invested 8 million euros… – and other investors in Ethical Coffee Company (ECC). Originally, this young company wanted to market biodegradable capsules compatible with Nespresso coffee machines. The idea was great but Nespresso opposed it at the time and even took Ethical Coffee Company to court, indicating that the shape of the capsule of Nespresso machines was registered as a protected trademark.

The court then ruled in favor of Nespresso and banned the sale of pods to Ethical Coffee Company for three years. A huge shortfall which will put the company out of business in 2018. In addition to this bankruptcy, the observation is clear: “Competitors rushed into the breach without being attacked“, said Maître François Besse, the lawyer for Arthur and the other creditors, this Tuesday, January 16 to AFP. The “pod war“, as the affair was nicknamed in the press, therefore benefited many companies, to the great dismay of Ethical Coffee Company, although it was a pioneer on the market.

An unfounded ban

In 2021, the Swiss federal court declared that the ban on Nespresso from marketing the famous pods was ultimately unfounded. According to the court, the shape of the capsule could not be registered as intellectual property, due to the impossibility of producing a pod compatible with Nespresso machines by changing the original shape.

It is for this reason that Arthur and other investors are calling for 278 million Swiss francs (or 298 million euros) to Nespressoas compensation, according to information from The Geneva Tribune that Le Figaro is able to confirm. If an amicable agreement is not found during the conciliation hearing which will take place on February 20, the creditors of Ethical Coffee Company, including Arthur, may decide to continue their legal action. The latter will then lead to “two to three years of procedure” clarified Maître François Besse, unless an agreement is finally reached in the meantime. Nespresso, which took “document filed by creditors“did not wish to comment”ongoing legal proceedings.
