But during the hearing, the defendant’s lawyer assured that his client had made these transfers in order to put the money of the nonagenarian “safe from guardianship”. Moreover, these tens of thousands of euros would not have been spent and should have gone to the daughter of the victim, who was severely disabled. The defendant was eventually sentenced to six months of detention at his home under electronic surveillanceas well as a permanent ban on exercising a profession related to the elderly. Finally, he must reimburse his victim for the 77,339 euros stolen from his account, and pay 1,500 euros for non-pecuniary damage.
