The law no. 2022-1587 of December 19, 2022 aimed at combating fraud in the personal training account and prohibiting canvassing of its holders now introduced the prohibition of any commercial prospecting of the holders of a personal training accountby telephone, by message from an interpersonal communications service, by e-mail or on an online social network service.
Prohibition to collect personal data
More specifically, it is now prohibited to collect personal data, in particular the amount of rights entered in the personal training account. Above all, it is now It is impossible to offer a contract via these canvassing methods. Clearly, it is now up to the holder of the CPF to take the steps to carry out training, the canvassers can no longer have a contract signed. An exception is however made for solicitations occurring within the framework of an action in progress.
And the penalties can be heavy for people who continue to do cold calling on the CPF. Any breach of this article is liable an administrative fine, the amount of which may not exceed 75,000 euros for a natural person and 375,000 euros for a legal entityfurther states the law.

In addition to this first article, the law also obliges organizations to submit a listing request to the Caisse des Dépts et Consignation. Training organizations must now be listed on the My Training Account platform in order to be certified.
Finally, if the holder of the CPF mobilizes undue rights (or in violation of the regulations), the Caisse des Dépts et Consignation may proceed to recover the undue amount by deduction from the registered rights.
