The Constitutional Court, on the other hand, rejected the challenge to the election of the Mattersburg municipal board of October 2022 through the list “TVM – Tschürtzwarts Mattersburg”. The list with Johann Tschürtz, FPÖ club chairman in the state parliament, justified its challenge by saying that the use of d’Hondt’s procedure for the election of the municipal council contradicted the principle of proportional representation and the principle of equality because it systematically preferred larger parties. In Mattersburg, this meant that TVM, which achieved three mandates, did not get any of the seven seats on the municipal board.
