Recover your file

When you change driving school (for one reason or another), you must recover your file to be able to re-register in another driving school. It includes the Cerfa 02 file and a monitoring sheet. Without these documents, the candidate will have to start their training from scratch: the code exam or the driving hours already completed will be lost. The file can be requested from the driving school. If the manager no longer has it, it is possible to obtain a duplicate free of charge from the “driving license” service of the prefecture.

I am canceling my contract, can the driving school object to my request?

The driving school cannot oppose your termination request, effective within 15 days from the first presentation of the registered letter or electronic registered delivery. If the termination is the consequence of a legitimate reason (illness, moving, professional transfer, etc.), this period does not run.

Concerning reimbursement, if your services were paid in the form of a lump sum, the driving school will reimburse you in proportion to the driving hours completed. Please note, in the event of termination without legitimate reason, before any start of practical training, the driving school may withhold a sum corresponding to the amount of costs exclusively linked to the termination, provided that it has expressly provided for and justified this in the contract. .

Transfer and return of the file: will costs be incurred?

Changing driving school does not cause no return or file transfer fees. L’article L.213-2 of the Highway Code states that “the return of the file to the candidate who requests it does not give rise to the application of any fees“. By charging you fees, the driving school incurs an administrative fine which cannot exceed €3,000 for a natural person and €15,000 for a legal entity. In the same way, the Hamon law of March 17, 2014 prohibits the costs of transferring a driving school file.

My driving school has gone bankrupt: what should I do?

You need to retrieve your administrative file as quickly as possible to continue your learning in another driving school. Reread your contract to check if your driving school has taken out a financial guarantee allowing reimbursement to the candidate of services paid in advance and not carried out. If this is the case, the name of the guarantor is also mentioned there. Get in touch with him. Unfortunately, this is not an obligation for driving schools. And without that, no refund is possible.
