Covid-19 – Towards a health pass at work: conditions, sanctions, logistics … the questions that arise


Setting up a health pass in a company, one of the solutions considered by the executive to limit the increase in contamination, would undoubtedly be effective, but difficult to set up.

What would the conditions be?

First, you should know that the health pass already exists in cafes and restaurants. Employees in these sectors have been using this sesame for several months. For other companies, it would be possible, but it would require a law, because they cannot take this responsibility alone. And then there is a major obstacle: the right to employment is enshrined in the Constitution. And some lawyers suggest targeting certain places more, such as those with a high risk of contamination, for example the cafeteria or the canteen.

If an employee does not want to submit to it, what happens?

There are several solutions. First, teleworking is offered, but this is not possible in all activities. Then, there is also the possibility of setting up a leave, the time that the employee settles in order. And as a last resort, the termination of the employment contract is planned, as we had seen elsewhere in the hotel and restaurant industry.

What will companies have to monitor?

Obviously, the corporate health pass also poses logistical problems. It is not a vaccination pass and therefore employees can either be vaccinated or have daily PCR tests. These must be checked regularly, which implies additional financial and material resources.
