Three years after the death of Alexia Fouillot, found dead on October 30, 2017, the case is not yet completely over. Convicted of her murder on the night of October 28, 2017, her husband Jonathann Daval was sentenced to twenty-five years of criminal imprisonment on Saturday, November 21, 2020 at the end of his trial. He is now behind bars in Dijon. But the 36-year-old computer scientist still does not know the amount of compensation he will have to pay to the victim's family. The parents, sister, brother-in-law, nephew, niece, as well as the uncles and aunts of the young woman who died him claim 750,000 euros. An amount that was debated when it was announced in the press in December 2020.

As reported Le Figaro, the Assize Court of Haute-Saône studied this request and these sums on Monday February 22, 2021. "Compensation for the loss of a loved one is by nature immeasurable. No sum can replace the presence of the loved one. I call for the civil aspect of this case to give rise to a decision that will be soothing for all the parts ", wanted to clarify Advocate General Emmanuel Dupic during the hearing.

The arguments of both parties

Jonathann Daval's advice argues that Alexia Fouillot's relatives should not receive more money than any other family who would find themselves facing such a tragedy : "It's not a little contemptuous for this father, this mother of a victim, to whom we will say that they will touch less [that the relatives of Alexia, editor's note.] because we talked less about their case? Those who suffer in silence don't have to be compensated less than those who suffer publicly. We must judge this file normally ", he pleaded. In December 2020, he was already offended by this requested amount, "four times higher than the usual case law ", in the columns of The Republican East.

Each party had the opportunity to detail their arguments. "I think it is extremely awkward, and false, to say that the civil parties are trying to coin money with this drama. If it really had been a question of money, they would have started the process much earlier ", for his part launched Master Jean-Hubert Portejoie, the lawyer for the parents, sister and brother-in-law of the victim, who judge "indecent" that the defense go so far as to contest the costs related to Alexia's funeral. The Assize Court has, from Monday 22 February 2021, a period of three months to render its decision: the two parties will therefore be set for Tuesday, May 25, 2021.
