Edeka continues to argue: Now customers are also included


The dispute between Edeka and Eckes-Granini has been going on for several months. After the supermarket chain refused to agree to higher prices, Granini refused to deliver juices. When Edeka then put its own brand Albi on the shelves, Granini complained against it. The bottles would look too similar to the Eckes-Granini brand. The result: Edeka had to take the products off the shelves.

On January 13, 2022, this case is to be heard before the Hamburg Regional Court. In advance, however, Edeka decided to take an unusual action, as “Lebensmittel Zeitung” reports. Now the customers are drawn into the dispute and basically asked whether Eckes-Granini’s lawsuit was justified.

There is currently a survey for customers in the Edeka newsletter. This is called “Your opinion is important to us” and comprises ten questions. These mainly revolve around the bottle design from Albi and the possible risk of confusion with bottles from Granini. Such surveys are seen more frequently in the context of a legal dispute over trademark rights, but are then carried out by trademark researchers.

Experts assume that Edeka expects to lose the negotiations against Eckes-Granini on January 13th. With the results of the survey – if they were positive for Edeka – the supermarket chain could then convince the next higher authority in a negotiation.
