  • The European Court of Justice is turning the tide regarding the ban on demonstrations that the Federal Council issued in 2020 to combat Covid.
  • The Grand Chamber considers the Geneva unions’ lawsuit to be inadmissible due to violation of freedom of expression and freedom of demonstration.
  • The first instance had approved the complaint from the Geneva Community for Trade Union Action 2022.

The umbrella organization of the Geneva trade unions had sued because they were unable to hold their May 1 demo in 2020. The Federal Council led by Health Minister Alain Berset banned events in March 2020 in order to combat the corona pandemic. Anyone who didn’t comply faced hefty penalties. Even a prison sentence of up to three years was conceivable at the time.
