How to challenge a fine for breach of confinement? : Current Woman Le MAG

To fight the spread of the new coronavirus, Covid-19, it's time for containment. Since Tuesday March 17, French women and men have been called to stay at home, except in certain cases (purchases of basic necessities, travel or practice of a sporting activity for example). For any outing, the presentation of the new attestation of derogatory displacement duly completed is compulsory.

225,000 minutes

In the event of non-compliance with the confinement rules or failure to present this certificate, a fine of 135 euros is provided. An amount which also goes to 1,500 euros in the event of a repeat offense within 15 days. Worse still, a 3,750 euro fine and 6 months in prison after four violations. Since the start of confinement, nearly 225,000 reports have been drawn up during the 3.7 million checks, according to Interior Minister Christophe Castaner.

Evidence to provide

Among those charged, some may possibly challenge their fine if they wish. And this is absolutely not prohibited, but you still need to be able to provide proof and supporting documents. Your good faith or your word cannot suffice. "The rules are the same as for traffic tickets. If you receive a PV for going red and you claim it was green, you have to prove it. It's always the same thing, "explains Maître Ingrid Attal, lawyer at the Paris Bar interviewed by the magazine Full Life. For this, it is better to keep all your supporting documents: receipts, letter from the employer, prescription or medical summons …

45 days to contest

In the event of a verbalization, the police will draw up a paper or electronic report, which you will receive a few days later by post. You will then be able to contest it by sending the exemption request form by mail; as with parking or speeding tickets, you can also fill it out on the ANTAI Internet portal. You have 45 days after receiving your fine to object.

To avoid getting there, is it better to respect all of the containment measures? In the event of a necessary exit, carefully complete the new derogatory travel certificate and take your identity document. Also, to facilitate control and prove your good faith, you can always present other supporting documents to the police, such as sales receipts or a medical summons.
