Imminent prison sentence – opponent kicked unconscious: footballer in court!

A physical altercation during a soccer match between two Viennese lower division clubs next Wednesday has criminal consequences for a now 19-year-old kicker! He has to answer for serious bodily harm at the regional court because on April 3, 2022 he is said to have headbutted an opponent and then kicked him in the head.

The athlete, who was nine years his senior, collapsed unconscious and had to be taken to a hospital in a rescue helicopter. According to the criminal complaint, he suffered “a severe concussion with loss of consciousness requiring intubation, abrasions on his face and minor motor damage to the radial nerve”. The 28-year-old – a prison guard by profession – has not played a football match since the violent encounter. The violent scenes took place in a first-class A match in Vienna-Favoriten. First, the 28-year-old conceded a headbutt from the younger opponent, whose team was 2-0 down at the time, after which the attacked player hit back. The result was a scuffle, during which the 19-year-old’s younger brother, who was a spectator, stormed onto the field and also attacked the 28-year-old kicked opposing kickers in the face with the soccer shoes. The seriously injured man had to be put into artificial deep sleep in the hospital. He was hospitalized for two days before being released into home care. According to him, the prison guard who kicked the ball was in severe pain until mid-May and is still suffering from the consequences of the assault. Prosecutors have already asked for the suspended sentence to be revoked, meaning the footballer could face jail if convicted. The public prosecutor had also investigated the brother of the 19-year-old. As the lawyer Nikolaus Rast, who represents the injured kicker, announced, his proceedings were completed diversionally.
