Jubillar case: Cédric’s request for release rejected, his lawyers refuse to go to the reconstitution

Criticizing “an empty file” and “abusive” pre-trial detention, the criminal lawyers say they are “outraged” by the functioning of justice. They do not intend to go to the reconstitution, for which they would not have received a summons.

They are more than a request for release near. Tuesday, October 18, the investigation chamber of the Toulouse Court of Appeal refused a sixth request for the release of Cédric Jubillar, suspected of being involved in the disappearance of his wife, Delphine Jubillar. Indicted for “murder of a spouse” on June 18, 2021, the defendant has since been in pre-trial detention, in solitary confinement.

Previously, in the absence of a total release, Cédric Jubillar’s lawyers had asked for release on an electronic bracelet, which they had been refused.

“We will not go to the reenactment”

Despite numerous testimonies and multiple excavations, “the investigation skates, again and again“, assure the lawyers of the Tarnais suspected of the worst. Because if the investigators had, from the first days of the disappearance of Delphine Jubillar, quickly dismissed the hypothesis of an accidental fall or a voluntary disappearance, no concrete element would seem for the moment to designate the husband as the culprit.

In the hope of ruling out the possible involvement of their client in the murder of his wife, the defense lawyers have, according to the Toulouse prosecutor’s office, demanded a reconstruction of the night of the tragedy. On November 9, this reconstitution should therefore take place “in the presence of Cédric Jubillar, if he agrees to participate“Said Toulouse prosecutor Samuel Vuelta-Simon.

However, contacted by Le FigaroMe Jean-Baptiste Alary, Cédric Jubillar’s lawyer, assures that he has not, for the moment, received “no summons“. “We had made a first request for reconstitution which, on the pretext that acts of investigation and expertise were in progress, had been ignored. Today, here it is ordained without us being told“, indignantly the penalist, claiming to have taken note of the date of the reconstitution “through the press“. “Until we receive a summons, we will not go to this reenactment“, has, in a confident tone, added the lawyer.
