NFTY (ALXP:ALNFT) announces that the Commercial Court of Lyon has decided, by judgment of December 20, 2022, to convert the receivership proceedings into judicial liquidation.
NFTY SA was placed in receivership on November 22, 2022, following a conversion of the safeguard procedure obtained on August 2, 2022.
The placement in receivership of NFTY had led the judicial administrator appointed by the Commercial Court of Lyon, Maître Eric Bauland, to publish a call for tenders with a view to the presentation of a continuation plan by partners or investors, or a transfer plan for the benefit of one or more buyers.
The deadline for submitting offers was set for December 2, 2022 at 12:00 p.m. The Commercial Court of Lyon heard the candidates for the takeover on December 20, 2022. No offer was accepted.
The Court pronounced the judicial liquidation without continuation of activity and, consequently, the activity of NFTY ceases completely as from this judgment.
However, society does not end. Pursuant to Article 1844-7-7° of the Civil Code (modified by Ordinance No. 2014-326 of March 12, 2014), the company is terminated by the effect of a judgment ordering the closing of the liquidation judicial for lack of assets.
