The ministerial conference on electronic invoicing on February 10 reflects the desire of the French presidency to initiate discussions on the generalization of electronic invoicing with a view to harmonization at European level. It will make it possible to organize a debate with European companies on this lever of tax simplification which represents an upheaval in the way many companies operate.

Electronic invoicing, a simplification lever for companies

Although B2B electronic invoicing is developing in the European Union and in several countries around the world, it has not yet been implemented by everyone. Yet it is a real lever of simplification for companies. For example, the generalization in France will contribute to increasing the competitiveness of companies by accelerating their digital transition, representing a gain estimated at €4.5 billion for the smallest of them. Ultimately, it could open up prospects for the pre-filling of value added tax (VAT) declarations. By improving the tools for combating tax evasion, it also contributes to fairer competition between economic players.

The objective is twofold: to simplify the tax environment and to fight against fraud for the benefit of economic operators in good faith.

Interest in this billing data dematerialization system is growing in Europe. B2B e-invoicing is one of the main areas for deepening European VAT rules. Thus, on January 20, 2022, the European Commission launched a public consultation on this subject. These developments will profoundly affect the practice of companies and the projects for the generalization of electronic invoicing launched in the various Member States.

After other states such as Spain and Italy, France has chosen to engage in this ambitious reform. One year after the report was submitted to the French Parliament VAT in the digital ageOrdinance No. 2021-1190 of September 15, 2021 laid down the legislative bases for inter-company electronic invoicing and enshrined in law the timetable for its generalization between July 1, 2024 and January 1, 2026.

The February 10 conference is intended to share implementation experiences and good practices to illustrate the methods of transition to electronic invoicing and the success factors for companies and the administration. It will be based on a shared perspective between Member States and between companies and administrations. The presence of European institutional and professional players will be an opportunity to discuss the interest of European convergence and the prospects for harmonization as well as the prospects for the development of European rules on VAT.

Alongside Olivier Dussopt, Minister Delegate to the Minister for the Economy, Finance and Recovery, in charge of Public Accounts, Vincent Van Peteghem, Belgian Deputy Prime Minister and Minister for Finance, Laura Castelli, Deputy Minister for Italian Finance, as well as Gonzalo Garcia Andrés, Secretary of State for Economic Affairs and Spanish Business Support will testify to the interest and hopes they have in the transition to electronic invoicing. Gerassimos Thomas, Director General of the Directorate General of Taxation and Customs Union (TAXUD) will present, on behalf of European Commissioner Paolo Gentiloni, the prospects for European harmonisation.

The most technical reforms are often the ones that make the biggest difference to our businesses and our growth model. With electronic invoicing, we can give substance in European law to an ambitious program for the transformation of public action and tax simplification which will enable States to better administer, better levy taxes and better fight against fraud.
