Long career. Ns in 1962 or 1963? This subtlety that allows you to escape the pension reform

Following the rejection of the motions of censure, the pension reform will come into force on September 1, 2023… unless surprised at the Constitutional Council. It raises the legal age and lengthens the period of contribution for all those who were born from September 1961. All? No. Except… for those who were born in 1961, 1962 and 1963 and who are eligible for the long career scheme.

A last minute measure, just to avoid the side effects of the entry into force of this pension reform.

A coordination amendment adopted in the Senate with the favorable opinion of the government, is well and truly integrated into the final version of the bill on which the government has committed 49.3.

This amendment aims allow policyholders born in 1962 and 1963 to still be able to take early retirement for long careers under current conditions, with a full pension rateto quote the Renaissance senators’ presentation in commentary on this amendment.

So much for the declaration of intent. This amendment was therefore adopted by Parliament, as was the amending Social Security financing bill for 2023, following the rejection of the motions of censure.

An amendment paving the way for a decree…

In the facts, the content of the amendment does not cite a year or month of birth. From a strictly legislative point of view, the law (which has yet to pass the Constitutional Council stage) does not guarantee the maintenance of the current system of long careers for the 1962 and 1963 generations but prepares the regulatory ground for doing so, since the bill refers to a decree.

At this stage, if you were born in 1962 or 1963, you will therefore have to wait for the long careers application decree following the promulgation of the reform to be sure that the current conditions apply.

In fact, if you were born in 1962 and you have validated enough trimesters (4 to 5 depending on your date of birth) before the end of the year of your 20 years, you have already turned 60 in 2022. And, if you also have a full career (168 quarters with contributions and assimilated, i.e. 42 years of active life), you have theoretically already been able to assert your pension rights, as confirmed by the simulator (pre-reform version) of Info-Retraite.

But the simulator am i concerned of the same platform creates some ambiguity by referring to the 169 quarters required for the 1969 generation… It should be noted that this latest simulator was put online in mid-January, therefore before the latest adaptations by Parliament. Including the Senate amendment quoted above… which effectively refers to a decree whose terms are still unknown at this stage.
