The advantages of the real regime for furnished rental companies

Rental income from a furnished rental is taxed in the category of industrial and commercial profits (BIC). Depending on the amount of rent collected, a lessor, whether he has the status of LMNP (non-professional furnished lessor) or LMP (professional furnished lessor), may be subject to the micro-BIC regime or the real regime.

While the micro-BIC offers a 50% allowance for the calculation of income tax, the choice of the real regime generally allows the taxpayer to avoid any taxation.

This also concerns those who derive more than €72,600 per year from their furnished rental activity, because in this case they are subject to the real regime.

Additional time to switch from micro-BIC to real regime

Furnished lessors subject to the micro-BIC regime, who wish to declare to the actual regime for the current year (year N), must send their option exercise letter to the tax authorities before the filing deadline. of their personal income tax return, i.e. in May-June 2022, the deadline depending on the geographical area and the taxpayer’s method of declaration (paper or internet).

For paper tax returns, the deadline is May 19. For online declarations, this is May 24, 2022 for departments 01 to 19, May 31 for departments 20 to 54 and June 8 for departments 55 to 976.

Indeed, following the finance law for 2022, furnished rental companies automatically covered by the micro-BIC regime (rental income below €72,600) can opt for the actual tax regime for year N until the last day for filing their tax return for year N-1, i.e. until May-June of year N.

Previously, this option had to be exercised before February 1 of year N.

Lessors who started their furnished rental business in 2022 have until May 2023 to exercise the option for the actual regime, i.e. when they file their first rental income statement.
