With the hosting of the Olympic and Paralympic Games (OPG) this summer, this is true in a certain number of areas (security measures, social measures, tax measures, etc.). This could also be the case at the level of the financial practices of municipalities. More precisely for those who decide to pay bonuses to their municipal police, or to their public highway surveillance agents (ASVP) for their mobilization this summer for the Games.
“I will not send instructions for the prefects to carry out a specific legality check on this subject”, promised the Minister of the Interior, Gérald Darmanin, on March 5 before the senators of the law committee. He thus mentioned the fact “that there is no legal basis for a mayor to grant a specific bonus” to its municipal police officers.
While emphasizing that a mayor “may grant overtime”Mr. Darmanin assured that he did not see “only advantages in creating a legal basis for a bonus”and recalled that“at the request of the former Prime Minister, Elisabeth Borne, we are working on the evolution of the status of municipal police forces”.

Present the same day in the Senate, for a debate on the theme “2024 Olympic Games: Is France ready?” », organized at the request of the Les Républicains group, the Minister of Sports and JOPs, Amélie Oudéa-Castéra, was also questioned on this subject. His assertion that “there is no need for a specific legislative provision to allow the territorial civil service to grant bonuses if employers so wish”however, was not convinced.
“I am completely happy to learn that local authorities can pay bonuses as they see fit, in the absence of any framework! reacted Christine Lavarde (Les Républicains). We will have to give this information to the regional audit chambers, because a number of municipalities that I know have been slapped on the wrist for having paid bonuses in the absence of a regulatory and legislative framework! »
If Mme Oudéa-Castéra clarified that this could be done “within the framework of existing provisions”,Mme Lavarde considered that she was “still can’t say” to the mayor of Boulogne-Billancourt (Hauts-de-Seine), whom she took as an example, “that it can grant a bonus to municipal police officers and ASVPs who will be mobilized during the period of the Games”.
As for the question of whether this exceptional mobilization of municipal police officers due to the Games could be the subject of compensation by the State, Mr. Darmanin rather dismissed it. “We can of course debate it, even if it is primarily up to the employer (…) Logically, the operation is not my responsibility”, he argued.
