Presented this Wednesday in the Council of Ministers, the bill for full employment incorporates a reform of the RSA. This provides for new obligations for the beneficiaries, but also new sanctions. Here is what changes.

This Wednesday, the government is presenting its bill for full employment to the Council of Ministers. With this text, the executive intends to reorganize the employment and integration services, and France Travail is intended to succeed Ple emploi by the end of 2024. It is in this context that the reform of the RSA appears, which began to be tested in 18 departments.

Today, 1.9 million people are beneficiaries of the RSA. With this reform, it is expected that a person applying for RSA at CAF will also find themselves registered with France Travail. Currently, only 40% of RSA beneficiaries are fully employed.

What will change with France Travail, the new organization that will replace Ple emploi

An automatic Ple emploi registration

This automatic registration France Travail, on the basis of common criteria, will allow rapid entry into the support course and visibility on all people looking for work in a territory, underlines Matignon.

Concretely, the bill plans to register as job seekers, France Travail, all recipients of the RSA, as well as their spouse, partner or PACS partner, if necessary.

A contract of engagement

Each member of France Travail will sign an employment contract. It is within this framework that renewed support for RSA recipients is being tested in 18 departments. The 15 to 20 hours of compulsory integration activities per week mentioned for RSA beneficiaries are not included in the bill, but will be an objective adapted to each person, the Minister of Labor Olivier Dussopt recently specified.

These activities, which will be neither free work nor compulsory volunteering, will be defined in the contract of reciprocal commitments between the beneficiary and his adviser, a contract which has existed since the creation of the RMI in 1988, indicated the Minister of Work.

Penalties provided

If the recipient of the RSA does not keep to the commitments of the support course, sanctions are provided for in the bill, as Elisabeth Borne had already indicated. There will indeed be the possibility of suspending, perhaps for a short period of time to start, in any case there will also be a system of sanctions as soon as we have accomplished, on our side, our share of responsibility, that is — to say that we will have put the beneficiary of the RSA in a position to follow the course that we have offered to him, explained in mid-May the head of government.

A suspension-remobilization device

Concretely, and this is a novelty compared to the sanctions currently provided for, there is a suspension-remobilization mechanism which allows the payment of the RSA to be suspended, without stopping the support of the beneficiary. With then a resumption of rights when the person respects his commitments, before a decision of deletion or radiation.

The bill specifies that the duration and the amount of this suspension are fixed with regard to the specific situation of the beneficiary, including in particular the composition of his household, and according to the nature and frequency of the breaches observed.
