Now an adult who asks for “nudes” from a minor under 15 risks jail and a heavy fine

Since March 15, 2021, if an adult requests pornographic content from a minor under the age of 15, he risks up to 7 years in prison and a 100,000 euros fine. Written into the law, this amendment was adopted unanimously.

Younger people are often blamed when they privately share intimate, naked photos, commonly referred to as "nudes." Indeed, even if these photographs are distributed by malicious people, it is most often the victim who is accused of having been reckless. Whereas, in any case, it is the person who disseminates the photo who is guilty and not the person whose photo was released. But, since March 15, 2021, asking a teenager for pornographic photos under the age of 15 is punishable by law.

The National Assembly, unanimously and at first reading, adopted the law to protect young minors from sexual crimes. In addition to this, you need to know more about it.

A brake on child pornography

Amendment 79 was added to the law, tabled by seventeen MPs. Today, if an adult requests pornographic content, images or videos, from a minor under the age of 15, he faces up to seven years in prison and a 100,000 euros fine. This will be enshrined in article 227-23-1 of the penal code. This amendment seeks to reprimand sexual predators and pedophiles, not victims. The fault will finally be entirely on the adult.

This amendment is in line with Emmanuel Macron's commitment in 2019, which was to punish people who consume child pornography images and videos much more severely. Article 227-23 of the penal code has therefore been updated: these people risk two to five years in prison, 30,000 fines as initially, and automatic entry in the file of offenders. sexual or violent. Previously, registration in this file was only automatic for sentences greater than or equal to five years' imprisonment. Now it concerns all those convicted.

Obviously, details are given about the phenomenon of “revenge porn”. It is possible to contact the platform for this illegal sharing, or to file a complaint directly. Revenge porn is indeed an offense punishable by imprisonment and a fine of 60,000 euros.
