In its ruling on December 19, the Colorado Supreme Court found it proven that Trump was guilty of insurrection against the United States in connection with his supporters’ storming of the Capitol. It invoked the so-called ban on insurrection in the 14th Amendment to the Constitution.

The judges of the Supreme Court made their decision in an unusually short time: it was only on Wednesday that Trump, the most promising candidate for the Republican presidential nomination in polls, appealed to the highest US court in this context. Trump’s lawyers have also lodged an objection against a similar exclusion of Trump from the election in the state of Maine.

Trial date on February 8th

How the Supreme Court might decide is unclear. The court is dominated by a conservative majority; three of the nine justices were appointed by Trump. The case is scheduled to be heard on February 8th in the court in the capital Washington.

In the USA, the primaries and the actual presidential election take place at the state level according to their respective laws and regulations. Therefore, they decide who is allowed to take part and how the voting takes place.
