The second round of the presidential election will be held on Sunday 24 April. It is also an opportunity to look into cases that could lead to the loss of one’s right to vote.
If the conditions for having the right to vote, which is also a civic duty, are mainly to have French nationality and to be of legal age, it is possible to be deprived of one’s rights. There are thus certain cases which entail the loss of one’s citizenship.
First of all, the public prosecutor has the power to order a “judicial annulment of a declaration of nationality” in cases where the legal conditions are not met within two years of the registration of this declaration, and/or in case of “lie or fraud”.
Again, the prosecutor has two years from the date of discovery of these cover-ups. You should know that this “cancellation” is valid for the future as well as for the past, that is to say that the individual can be “deemed to have never been French”.
We then find the loss of his nationality by “lack of effect”. For this, three conditions must be met: to obtain the nationality of another State, that is to say to have dual nationality, to behave like a citizen of this State and finally to commit acts going against the interests from France.
But this loss by “lack of effect” can also be applied to people in military activity, in a foreign public service or in an international organization of which France is not a member. Of course, if such activity is continued despite the government’s order to cease it, the loss of nationality is applied.
And finally, the “forfeiture of nationality” completes this list of cases of loss of civil rights. For this, two conditions must be taken into account. Having acquired French nationality and having another nationality, since “the forfeiture cannot have the effect of rendering the person concerned stateless”.
Following this, a commission of particularly serious offenses can pronounce forfeiture in the event of “a terrorist act, a crime or an offense affecting the fundamental interests of the Nation, or even affecting the administration committed by a person exercising a service, or failure to comply with the obligations of the national service code”.
On the other hand, it should be known that if an inmate has not been sentenced to a ban on civil rights, he can still vote. However, he will have to do so by proxy or by correspondence, and above all he must be registered on the electoral lists.
