Faced with the accumulation of technical malfunctions and inconsistencies in the new forms put online on the one-stop shop for business formalities, mandatory since 1er January, Bercy returns to the age of paper. This Thursday, the National Institute of Industrial Property (Inpi), the operator of this counter, sent an email to all of its partners to indicate to them the use of paper filing for certain formalities.

For natural persons, these are declarations of transfer of business, transfer or opening of an establishment, death of the operator with continuation of operation or request for temporary maintenance within the registration register. For legal persons, declarations of transfer and opening of establishment, modification of the legal form, modification relating to managers or partners, dissolution or cessation of activity without disappearance of the legal person are also concerned.
“Chaotic”
Bercy thus put in place a second emergency procedure, while the first, already activated, proved to be insufficient, or even ineffective, to absorb all the flows. “This one-stop-shop project was rolled out chaotically“, indignant Pierre Aïdan, the co-founder of the “legaltech” Legalstart. “This single digital entry point is not accessible, for a number of procedures, and does not allow the transmission of files. It’s going back ten to fifteen years. We are forced to write letters and send them to the various competent authorities and clerks. It is the whole management of business life that is slowed down or at a standstill“, he laments.

This situation is all the more aberrant, as from September 2022, certain players, noting the weaknesses of the system, had asked for the general opening of this platform to be postponed. Last December, smelling the disaster, their demands became more insistent, in vain, Bercy remained inflexible. This rigidity arouses the greatest incomprehension, which is more in a tense economic context.
