The Easter days in 2017 changed the life of Sergio Esposito (49) from Lucerne. His father Cosimo Esposito was the victim of a homicide. The 85-year-old was brutally beaten to death in the St. Urban psychiatric clinic – by his highly schizophrenic roommate Adnan X. * (37), who had recently been admitted.
The son not only had to mourn his beloved papa, but also had to pay tens of thousands of francs for the fateful night of the crime.
Private plaintiff pays himself – because the perpetrator is incapable of guilt
Because instead of receiving satisfaction, Sergio Esposito’s bills are piling up. The problem: the perpetrator is not responsible And that’s why Sergio Esposito has to bear his party costs as a private plaintiff himself. All of his savings of almost 40,000 francs went on it.
A senior physician at the psychiatric clinic has already been acquitted – the proceedings against the doctor on duty are still pending. Esposito also appears as a private plaintiff in these two proceedings – and in these proceedings too he pays everything out of his own pocket.
Savings used up – but Esposito wants to continue
The Lucerne resident, who works in the cleaning industry, says: “I am a poor man, have a very low income and can barely get through with my family. Over the years I have been able to save a little thanks to additional jobs. Now my father is dead – and my savings are gone. ” That is why Sergio Esposito is now collecting donations.
He also needs money because he would like to go to federal court. Because Adnan X. * (37) was found guilty of premeditated homicide by two instances. But because of his mental illness, he was only condemned to inpatient therapy. The second instance has now limited this to three years. Sergio Esposito found it unacceptable: “The perpetrator could soon be released. That can not be. In addition, all legal fees were paid to him – but not to me as a family member of the victim. “
The state paid for the offender’s official defense counsel
So far, the state has paid for the perpetrator: the public defender costs more than 20,000 francs in the first trial, and just under 35,000 francs in the second instance.
“Where’s the justice?” Says Esposito. «I can now only hope for a lot of solidarity from people who support me. Because no one else will help me. ” It is crazy that as a family member of a victim one is left behind. «I sleep very badly now. The whole matter affects me psychologically – but unfortunately nobody in Switzerland is interested in the relatives of the victim of such a serious act of violence. “
When Blick asked whether the St. Urban psychiatric clinic would donate an amount out of solidarity – and not as an admission of guilt – Daniel Müller, head of the management staff, replied: “The tragic incident continues to weigh heavily on us. We regret the private situation of the victim’s family. The conclusion of the ongoing proceedings must be awaited, so we ask for your understanding that we do not want to comment on this at the moment. “
