The story, sordid, had marked the spirits. The prosecution requested Tuesday between nine months and a year in prison against four young people tried behind closed doors for violence and sexual assault, in 2017 in Creil, against Shaïna, 13, who will be murdered two years later. After two days of trial, the correctional court for children of Senlis put its decision under advisement on March 1.
The defendants, under judicial supervision, were minors at the time of the events. Two of them, including the main suspect, then boyfriend of Shaïna, were 14 years old, the other two 16 and 17 years old. Initially indicted for rape, the three youngest are tried for sexual assault and violence in a meeting that occurred on August 31, 2017, a scene filmed. The oldest is suspected of another assault, committed on August 24, 2017.
“First time offenders”
Designating the former boyfriend as “the leader” of the trio, the prosecution requested two years in prison against him, including one year suspended on probation, also holding against him the head of “capture of images of violence and sexual assault”, said Shaïna’s family lawyer, Me Negar Haeri. The same sentence was required against the 17-year-old defendant, suspected of the other assault.
The prosecution also requested nine months in prison and six months of probation against the two other defendants. Prison sentences will be adjusted. The prosecution took into account the “very young” death “first-time offenders”, said Me Haeri.
For their part, the defendants, who contest the attack, “reiterated that it was Shaïna who wanted to force” her boy friend “to a sexual relationship, that he filmed her to dissuade her and that she then gave him a dirty blow”, said the lawyer. The defendants’ lawyers all pleaded for release, citing an empty file.
Gearing and “relentlessness”
“The prosecutor wanted to pay tribute to Shaïna before making his requisitions. We were listened to and we got the answers to all our questions,” greeted the teenager’s brother, Yasin Hansye, expressing his “great confidence in justice”. The gear, according to the complaint filed by Shaina, engages when her boyfriend takes a photo of her naked, which he uses to blackmail her. At his request, she will join him in a disused clinic, where the trio will rape her and film her. A video showing her partially naked, trying to hide her sex under the insults, will be found.
Images of the scene posted on Snapchat earned Shaina, according to her brother, a reputation for “easy girl” exposing it to a “relentlessness” in his neighborhood. On May 1, 2019, Shaïna will file a complaint again for having been beaten up by her former boyfriend, facts still under investigation. Then, on October 25 of the same year, pregnant for a few days, she was stabbed and then burned alive in a shed in her city. Facts for which another 17-year-old, with whom she had a relationship, was indicted.
