Should you take out (or not) legal protection?

Noisy neighbors or those encroaching on your land, a problem with a merchant or an employer: benefiting from legal protection can prove useful to ensure your defense and cover the costs linked to the conflict. Offered by insurance companies, legal protection is a guarantee little known to the public.

“Insureds often do not know whether they are covered or not, because legal protection is often associated with their comprehensive home insurance”, indicates Cédric Ménager, CEO of the insurance comparator Les Furets. But legal protection can also be purchased alone, and is attracting a growing number of policyholders. France Assureurs indicates that contributions increased by 6% between 2021 and 2022, and represented 1.7 billion euros in 2022 (latest figures available). Around 40% of individuals would benefit from this guarantee.

Legal protection covers the costs linked to a dispute: lawyer’s fees, expert opinions or bailiff’s fees, “but above all it provides precise legal advice which allows problems to be resolved amicably”, recalls Nathalie Aubonnet, general manager of Juridica, an Axa subsidiary dedicated to legal protection. It covers conflicts in very diverse areas of daily life, starting with that of consumption, particularly in the event of disputes after a purchase, sale or rental of goods.

Disputes with an employer or employee also fall within the scope of this guarantee, such as in the field of health (bad diagnosis, nosocomial infection) or even problems with the administration, such as the non-provision of an administrative document. .

In addition, disputes related to housing, automobiles or even cyberharassment and cyberattacks are also covered. Insurance companies offer more comprehensive legal protections including conflicts with craftsmen during the execution of work in the event of poor workmanship or interruption of the construction site.

Limits

Finally, a third level includes family conflicts: “It could be a divorce. In this case, legal protection defends each of the spouses”, explains Cyril Leclerc, Deputy Managing Director of Allianz Legal Protection. It can also be used for problems related to an inheritance.

The more comprehensive the legal protection, the more expensive it is. It is between approximately 7 and 10 euros per month for the first level of guarantee (84 and 120 euros per year), but the contribution can go up to around fifty euros per month when it includes the third level of guarantee.
