A family has moved into the apartment next to Karl and Karla. The daughter plays drums. She dreams of a career as a rock musician. She practices for hours every day. Karl can’t stand the noise anymore and complains to the neighbors. But they don’t have an open ear.
It is not forbidden to practice with a musical instrument during the day. There should only be peace at night. Karl disagrees. Karl complains that he doesn’t have to put up with the noise. Can a tenant play drums in the apartment? Are you allowed to do that?

The answer
No. Emissions from very loud instruments such as drums or trumpets are considered excessive and must not be tolerated by either tenants or apartment owners. If you don’t live in a detached single-family home, you have to look for the best soundproof practice room to practice with such instruments.
Drums no, violin yes
The following applies to other musical instruments: making music is a personal right. A ban on playing an instrument in the home would therefore be invalid and irrelevant. You can practice during the day, even in old buildings with ring noise. However, the municipal police regulations must be observed.
These stipulate that there must be silence during midday and from 10 p.m. at the latest until 6 a.m. in the morning. In addition, house rules or condominium owner regulations can extend the rest period (e.g. 8 p.m. to 8 a.m.) and limit the duration of exercise to two to three hours per day.
Important: Practicing with an open window or on the balcony is not permitted.
