The Constitutional Council validates the 2023 budget and the use of 49-3 by the government


The Elders have notably validated the establishment of a balance payable on the personal training account.

The government can breathe: the very spendthrift budget for 2023 has just passed the final stage of the Constitutional Council, which validated the main lines of this text in a decision published Thursday. The Elders had been seized of two appeals filed, for each, by more than sixty opposition deputies. This decision is not really a surprise but, more than in previous years, it was expected in this very delicate political context. Unlike the previous Macron five-year term, the presidential camp in the National Assembly only has a relative majority and therefore faces opposition in a position of strength. Also the executive did not hesitate to use article 49-3 of the Constitution to adopt the different parts of this text in first and second readings, without submitting them to the vote of parliamentarians.

A practice that has been widely denounced by the opposing camps. “The Constitutional Council dismisses criticism relating to its adoption procedure”, says the institution in its press release. It also considers that parliamentarians’ right to amend has been respected, rejecting the referral of deputies who considered that amendments would not have “not treated” neither “on the agenda”.

Moreover, the Sages reject all criticisms attacking the sincerity of this finance law and in particular its economic forecasts. In particular, they judge that the 1% GDP growth forecast in 2023, on which its scenario is based, is not tainted “of an intention to distort the main lines of the balance of the law” budgetary.

On the other hand, as so often, the Constitutional Council censured seven provisions which, according to him, have no place in a budgetary text. These “fiscal riders” notably include an article authorizing the government to take measures, by ordinance, to modify the framework within which customs conduct their operations of inspection of goods, transport and people.
