The UFC-Que Choisir anti-cold-calling tip

According to a study by UFC-Que Choisir, published in October 2023, 72% of respondents are contacted at least once a week by telephone canvassers. At the end of the year, the association is proposing to regain control over its personal data with a tool called Respectemesdatas.fr.

One year already. Since January 2023, businesses must use a 09 to avoid deceiving the customer in the context of commercial canvassing. And since March, any call of this type has been prohibited from Monday to Friday before 8 a.m., between 1 p.m. and 2 p.m. and after 8 p.m. as well as on weekends and public holidays. However, the phenomenon does not seem to be weakening and is even intensifying. To deal with this, UFC-Que Choisir is launching a new system to block the transfer of your telephone number for commercial purposes. Baptis Respectemesdatas.frit allows you to regain control over the sharing of your personal data.

Once on the platform, choose the Exercise your rights tab and enter your mobile operator and your email address in step 1. In step 2, note your first and last names and your telephone number. Respectemesdatas.fr automatically generates a standard letter, asking your operator to no longer transmit your telephone details to the public directory, generally used for commercial canvassing.

Fines and prison sentences

According to a study by UFC-Que Choisir, published in October 2023, 72% of respondents are contacted at least once a week on their smartphone. 38% say they do it at least once a day! Sanctions are provided for canvassers who do not respect the rules. The violation is punishable by the administrative fine provided for in article L. 242-16 of the Consumer Code (75,000 euros fine for a natural person and 375,000 euros for a legal entity), specifies the Repression of Fraud (DGCCRF) in a communication.

In 2021, the DGCCRF has already sanctioned numerous companies not respecting the previous rules: 3,196 establishments were inspected, leading to the sanction of 138 professionals for a total fine of 3.5 million euros.

More generally, beyond the sole question of canvassing, prison sentences are reinforced to fight against scams and aggressive commercial practices.
