these tips to get around the rental ban after January 1, 2025

While housing classified G in the energy performance diagnosis will be prohibited from being rented from January 1, 2025, solutions exist to avoid this sanction.

No disruption to the calendar, but several ways to continue renting accommodation considered as an energy sieve (these properties classified F or G in the energy performance diagnosis, Editor’s note). This is, in essence, what the Minister of Energy Transition Christophe Bchu announced this weekend in an interview given to Parisian. As a reminder, properties classified G in the DPE can normally no longer be rented from January 1, 2025. This ban will then apply to housing classified F in 2028.

If the minister assured not to touch the timetable and the ambition, it is clear that solutions exist for owners of energy-intensive goods who would like to circumvent the ban. Christophe Bchu, for example, declared that a change in the method of calculating the DPE would remove 140,000 housing units from the thermal sieve category. A first breath of fresh air for many owners, now free from work.

No rental ban if agreed with the tenant?

In his interview with Parisian, the Minister of Ecological Transition also announced that Guillaume Kasbarian, the new Minister of Housing, would propose two amendments. The first will remind you that January 1st is not a cut-and-dried date: the need to have done work to re-rent a class G thermal strainer will only apply at the time of renewal of the lease, either by tacit renewal, or upon change of tenant. Clearly, an owner who rents a G-class property in November or December 2024 would have several months ahead of him before the ban.

In addition, the minister hopes that in the event of tacit renewal of the lease, the lessor owner cannot be held responsible for renting a strainer if his tenant refuses leave for work. In other words, I wish that the refusal by a tenant to move from G-class accommodation during its renovation is an exemption clause work for the owner.
