On November 19, a judge recommended that the Baskins’ motion for an injunction also be dismissed, and on November 23, Netflix and Royal Goode filed a motion for the lawsuit to be dismissed outright. The Baskins withdrew their injunction on December 3rd.

In a statement on their website, Carole and Howard Baskin claim the lawsuit is not about money. They would only have tried to remove footage of themselves from Season 2, not to prevent the sequel from broadcasting.

“We believe they could have easily removed the footage, which we believe would have been ethical,” the statement said. “This litigation was never about damages. After the injunction was denied, Season 2 aired. It received generally poor reviews and quickly fell out of Netflix’s top 10.”
