The alcoholic driver races through the city at excessive speed. In a 30 zone he loses control of his vehicle and hits a tree. While the 19-year-old and a passenger survived the accident almost uninjured, another passenger was seriously injured. An alcohol test on the driver shows just under 1.0 per mille. During the trial, the defendant admits his guilt and describes his behavior as terrible: “The thought that my friends could have died still bothers me today.” Public prosecutor Wilfried Siegele sees the 19th Year-olds, however, are by no means purified: “Excessive speed, overtaking on the protective path and now this! This cannot be surpassed in terms of ruthlessness and shows the defendant’s indifference!” Judge Martin Mitteregger followed the prosecutor’s statements and imposed an unconditional fine of 4,200 euros on the 19-year-old boy.
