Because of the pandemic, many people are foregoing the pre-Christmas shopping spree through the city center this year and prefer to order online. Like COMPUTER BILD reader Gerd N .: He discovered an Aukey smartwatch on the Internet that he wanted to give away on Christmas Eve. The watch was available for a mere 10 euros thanks to a voucher code. But the bargain turned out to be a nuisance: When Gerd N. wanted to enter his address during the ordering process, Aukey’s system bitch and independently changed the house number from 15 to 05. All efforts to correct the mistake failed.
The result: the package was returned to the sender several times. Contacting the service was also unsuccessful. Finally, Aukey emailed the customer to go to the wrong address and wait for the package there. An unreasonable challenge for the physically handicapped Gerd N. – he turned to COMPUTER BILD for help.

Who is responsible for ensuring that the correct address is on the package at the end? Lawyer Thomas Hollweck explains: “Basically, the customer must ensure that he transmits his contact details correctly. If he notices a malfunction, it is his responsibility to inform the other party – in this case Aukey – that his address data was not recorded correctly. The best way to do this is by email, but it can also be done by phone. After the customer has submitted his address data and the other side has demonstrably received it, the customer has fulfilled his legal obligation. The dealer must then properly deliver the goods to the customer. If he doesn’t manage that, then it’s the dealer’s fault. ”From Thomas Hollweck’s point of view, Gerd N. has exhausted all possibilities.
Aukey turns mute
The editors asked Aukey why Gerd N.’s correct address was not taken over despite his best efforts. However, this request remained unanswered at the time of going to press. The smartwatch – along with many other products – has now also disappeared from the manufacturer’s side.
That fits with the impression that shipping giant Amazon apparently also has of Aukey: A few months ago, the manufacturer was thrown out of the range there – because of several violations of Amazon’s guidelines. The miserable service certainly does not ensure that trust in Aukey increases again – on the contrary.
But what happens now with Gerd N.’s order? According to Thomas Hollweck, he can withdraw from the contract due to delivery problems. That has happened in the meantime. Gerd N. is now looking for a new Christmas present.
