The worst “energy sieves” can no longer be rented from January 1, 2023. What accommodation is affected?

Bad weather for “energy sieves”, these dwellings classified F or G in the energy performance diagnosis (DPE). Indeed, the most poorly rated properties will now be subject to various sanctions. Thus, from January 1, 2023, the most energy-intensive dwellings, i.e. consuming more than 450 kWh of final energy per m² per year, also called “G+”, can no longer be rented out, except for energy renovation work. This will be followed by housing classified G in 2025, then those classified F in 2028.

Prohibitions that could weigh very heavily on the French housing stock. According to a study conducted by the National Observatory for Energy Renovation (ONRE), 5.2 million housing units, out of the 30 million main residences in France, are classified F or G, i.e. 17.3% of the stock.

140,000 goods affected by the ban

But then, how many homes will be affected by the rental ban on January 1? In one article, Capital reports “510,000 G+ classified homes, i.e. 10% of the thermal sieves listed in France. But these dwellings are in fact mostly houses inhabited by owner-occupiers. Still according to ONRE, “only” 140,000 properties rented out by individuals today exceed this threshold and could therefore be excluded from the park if they are not renovated.

However, Article 2 of Decree No. 2021-19 of January 11, 2021 provides that this prohibition applies “only to new rental contracts entered into as of this date (January 1, 2023)”. For example, if you entered the accommodation in January 2022 by signing a 3-year lease, the accommodation will remain rented until January 2025. However, the owner cannot renew the lease afterwards.

For the landlords concerned, three solutions: sell the property, continue to rent despite the ban, or make the property a seasonal rental. Indeed, the ban on renting thermal sieves applies exclusively to primary residences. Houses or apartments rented as furnished tourist accommodation are not affected.
