who will win with the end of the penalty?

The end of the famous Agirc-Arrco penalty, which reduced the supplementary pension of young retirees, is happening in two stages. The first, for new retirements, has already passed. The second, that of the end of the penalty for those who pay it every month, will be for this Tuesday, April 2!

The Agirc-Arrco penalty is over! At least, as of April 1, 2024, this bonus-malus system, precisely called solidarity efficiency, disappears. If you have retired recently, within the last three years, this deletion will cause a sudden boost to your supplementary pension.

Indeed, with this solidarity coefficient system, even if you retire at full rate (i.e. with all the required quarters), the Agirc-Arrco supplement still reduces your pension by 10%. A temporary penalty, however: limited to 3 years of penalty, or ending in any case at age 67 even if you had not completed your 3 years of penalty. The only way to escape it is to work another year.

Agirc-Arrco: I am retiring. Why do I lose 10% on my supplement?

This measure specific to the supplementary scheme, governed equally by employer and union organizations, was decided for budgetary reasons and to encourage you to continue working for another year, even when reaching the full rate.

With pension reform gradually pushing back the retirement age, this system became useless. Reason why Agirc-Arrco removed it in its latest national inter-professional agreement, signed last October by unions and employers’ organizations.

A two-stage deletion, in December 2023 and April 2024

The deletion was done in two stages: since December 1, 2023retirement is done without any penalty, at least if you retire at full rate.

The second phase of suppression occurs at April 1, 2024: if your supplement is reduced each month by 10% since your retirement, between 2021 and 2023, then this penalty disappears automatically.

Will you be reimbursed for the penalty already paid?

No. This total disappearance of the Agirc-Arrco penalty applies for the future, for supplementary pensions paid from April 1, 2024, but the elimination is not retroactive. There will be no reimbursement of penalties paid in recent years.

A new feature visible on your supplement paid on Tuesday April 2

Coincidence of the calendar and public holidays… This change planned in the inter-professional agreement on April 1 will be visible the next day, Tuesday April 2, since the payments of supplementary pensions, scheduled every 1st of the month in theory, are postponed by one day or two if they occur on a weekend or holiday.
