Will Ripple win against the SEC?

Since Ripple (XRP) was classified as a security by the SEC (Securities and Exchange Commission) in late December 2020 and subsequently sued, XRP investors have had to be patient. The lawsuit is not only directed against the company itself, but also against the two founders Brad Garlinghouse and Chris Larsen. The authority is accused of having issued an unregistered security. The XRP price then collapsed while the rest of the crypto market continued to move north.

The next bad news Then came on January 19, 2021 when one of the world’s leading crypto exchanges, Coinbase, announced that it would delist XRP, i.e. suspend trading in this altcoin, due to the smoldering legal dispute. As a US-listed company, Coinbase was forced to take this step as long as there was no legal clarity. Coinbase CEO Brian Armstrong then sharply criticized the SEC, fueling rumors of a possible relisting. Investors have been waiting in vain for this to this day.

SEC vs. Ripple (XRP): A legal tug of war

Ripple itself has sufficient financial resources in the $100 million court case and has used all legal means to counter it from the start. This includes, among other things, the request to release the so-called “Hinman documents”. These could benefit Ripple, as former SEC Treasury Director William Hinman is said to have stated in them that he does not consider Ethereum a security.

And it is precisely with these documents that Ripple is now getting support from the popular crypto lawyer John Deaton. This one goes in one tweet assume that these documents will in any case be released sooner or later. In addition Deaton keeps firing against the SEC as this one legal slap in the face by a US court in relation to the Voyager bankruptcy. The judge criticized the agency for failing to establish a metric that clearly defines which cryptocurrencies are unregistered security offerings.
