The case of the “Szeneishwinti” operator could come before the higher court. The public prosecutor’s office has filed an appeal.

The operator of the “szeneishwinti_blog” channel, which has now been deleted, warned of police traffic controls on Instagram and therefore has to pay a CHF 1,800 fine.
The public prosecutor’s office has now filed an appeal against the judgment of the District Court of Winterthur. This could bring the case to the higher court.
The operator of the former Instagram account “szeneishwinti_blog” was fined 1,800 francs for multiple warnings about police traffic controls. As stated in a letter that is available for 20 minutes, the public prosecutor’s office has well Appeal filed against the oral judgment. The 29-year-old Instagrammer says about it: «I have seen my mistakes and have to pay for them. I don’t understand why the prosecutor wants to move the verdict on.»
His lawyer Matthias Fricker is also astonished. “The whole thing is very annoying for my client. He confessed and accepted the penalties. Now the matter is not yet over and the next round is on. “ Fricker is now waiting for the well-founded judgment. He has already made a cross appeal. “I hope, however, that the public prosecutor’s office will recognize once the reasoned judgment has been made that moving on is not worthwhile and that the appeal will be withdrawn.”
“It is not a serious case”
The prosecutor had a fine of 16,200 francs required. According to the indictment, the fault weighs heavily. The reason: the accused reached an indefinite number of people with the publication of the controls on Instagram. So that counted in the meantime deleted Insta channel «szeneishwinti_blog» almost 6500 subscribers.
That saw that B.ezirksgecorrect differently. As the judge said in the statement of reasons, it is not a serious case. For example, the location of the controls was not always clearly indicated in the Instagram stories uploaded. The account was also not specialized in warning of traffic controls. The 29-year-old was satisfied after the verdict: “My goal was to get a bus that would not affect my standard of living. I achieved that. ”
Thereupon the followers of the Winterthur Instagrammers announced that they would support him financially.
